The Bank Guarantee
The bank guarantee ensures that the construction will be completed in full, no matter what happens. The bank is committed by this guarantee to finish the building without any dispute.
The Perfect Completion Guarantee
This guarantee covers imperfections, malfunctions, and defects that you may notice upon delivery of your apartment with the project manager, as well as any claims reported within 12 months following the signing of the delivery report. Damaged tiles, a floor that doesn't match the one chosen, a defective outlet, a poorly fitted door, or a leaking faucet are examples of issues you might find in your property.
This perfect completion guarantee holds the builder responsible, who is obliged to cover the necessary repairs. If the builder fails to comply, you have the option to take legal action to claim compensation for delays or to have the repair work done by another construction professional.
The Biennial Guarantee
The biennial guarantee is a guarantee taken out by the builder. It covers, for a duration of 2 years from the delivery of the property, all damage and malfunctions of removable and detachable equipment in the property, such as shutters, radiators, doors, the intercom, the water heater, the air conditioner, or plumbing fixtures.
If you encounter such damage, you have the option to send the builder a formal notice by registered letter with acknowledgment of receipt to repair or replace the defective equipment. If the builder refuses, you can take the matter to the District Court, which can compel the builder to carry out the necessary repairs or replacement of the affected equipment.
The Ten-Year Guarantee
The ten-year guarantee is also taken out by the builder and runs for 10 years from the delivery of your apartment. It covers significant damage to your property that compromises the structure or usability of the building, such as waterproofing issues, cracks in the façade, or heating system malfunctions.
If damage falling under the ten-year guarantee is detected, it is recommended to have the damage documented by a bailiff, then send the builder a formal notice by registered letter with acknowledgment of receipt to carry out the necessary repairs.
